Warranty Policy
All Sit and Move products are covered by both our express manufacturer’s warranty and the non-excludable consumer guarantees under the Australian Consumer Law (ACL).
1. Sit and Move Express Warranty
- Warranty Period: All Sit and Move products carry a minimum 1-year warranty. Many products come with extended warranties of 10 to 15 years. Therapod X chairs come with an 18 year warranty. Fabrics used in upholstery have a 3-year warranty unless the fabric manufacturer has stated otherwise.
- Coverage: Subject to the conditions of this warranty, Sit and Move will perform necessary service on the product (without charge for parts or labour) if, in the reasonable opinion of Sit and Move, the product is found to be faulty due to a manufacturing defect within the applicable warranty period.
- Applicability: This warranty applies only to Sit and Move products sold by Sit and Move Australia, and only where the products are used within Australia. Any products from other Suppliers we revert to their warranty conditions.
- Exclusions: This express warranty does not cover damage, malfunction, or failure resulting from:
- Accident, misuse, neglect, or abuse.
- Build-up of dirt or dust.
- Maladjustment of customer controls.
- Infestation by insects or vermin.
- Tampering or repair by unauthorised persons (including unauthorised alterations)
- Freight and Transportation for Warranty Claims:
- Freight charges for warranty claims are not included in this express warranty, unless a fault or damage is notified within 7 working days of receipt of the product.
- Alternatively, clients can bring the product (e.g., chair) to their nearest Sit and Move store for warranty assessment and service.
- This express warranty excludes any costs associated with the installation, de-installation, or re-installation of a product, delivery, handling, freighting, transportation, or insurance of the product or any part thereof or replacement. It also excludes any damage or loss occurring by reason of, during, associated with, or related to such installation, de-installation, re-installation, or transit.
- How to Claim Express Warranty Service: To claim service under this express warranty, you should contact the nearest Sit and Move store from which you purchased the product.
2. Your Rights Under the Australian Consumer Law (ACL)
In addition to our express warranty, Sit and Move products come with consumer guarantees that cannot be excluded under the Australian Consumer Law. These guarantees provide you with statutory rights regarding the quality, fitness for purpose, and description of goods and services.
- Major Failure: If there is a major failure with the product (meaning it cannot be remedied or a reasonable consumer would not have purchased it if they had known about the problem), you have the right to:
- Reject the product and elect to have a refund, or
- Have the product replaced, or
- If you wish, you may elect to keep the goods and be compensated for the drop in value of the goods.
- You must notify the Sit and Move store you purchased from within a reasonable period if there is a major failure that cannot be remedied.
- Minor Failure: If the product fails to be of acceptable quality and the failure does not amount to a major failure, you are entitled to have the product repaired or replaced. Sit and Move may choose to repair or replace the product and will do so within a reasonable period of time from receiving notice from you.
